By accessing or using the NavyBlue mobile application ("App") and website ("Service"), you agree to these Terms of Service. If you do not agree, please discontinue use immediately.
NavyBlue is operated in South Africa and aligns with the CAPS curriculum. The Service is intended for South African users only.
2. Description of Service
NavyBlue provides digitised past examination papers and memorandums for Grade 10-11 Mathematics and Physical Sciences, digital marking tools, topic-level performance analytics, and progress persistence across sessions.
3. Eligibility
Age Requirements
- You must be at least 13 years old to use the Service.
- Users under 18 require permission from a parent or guardian.
Geographic Scope
- The Service is only available to individuals physically located within South Africa.
- Content is aligned exclusively with the South African CAPS curriculum and is provided in English.
4. Accounts and Future Features
The current version of the App does not require the creation of a user account; all data is stored locally on your device.
If account functionality is introduced in the future, you will be notified in advance and responsible for safeguarding your login credentials.
5. Acceptable Use
You agree not to engage in any activity that is unlawful, infringes intellectual property rights, or disrupts the Service.
Prohibited behaviour includes:
- Sharing, distributing, or reproducing examination papers beyond personal study use.
- Reverse engineering, decompiling, or otherwise attempting to extract the App's source code.
- Using automated systems (bots, scrapers) to access the Service.
- Uploading malicious code, viruses, or harmful content.
- Commercial exploitation of the Service without written permission.
- Using the Service to cheat or violate academic integrity policies.
Permitted use includes:
- Personal educational use for exam preparation.
- Marking your own practice papers.
- Tracking your academic performance and sharing the App with other South African students.
6. Intellectual Property
All original App design, features, and content are owned by NavyBlue. Past papers remain the property of the South African Department of Basic Education, and are provided under educational fair use principles.
You retain ownership of marks, notes, or data you input. By using the Service you grant permission for that data to be stored locally on your device to deliver the Service.
7. Content Accuracy
We make reasonable efforts to ensure exam papers and memorandums are accurate; however, we do not guarantee that every resource is error-free. Please report inaccuracies to the contact channels below so we can address them promptly.
8. Feedback and Community Participation
You may provide feedback through our email. By submitting feedback, you grant us permission to use it without compensation.
Community participation requires respectful conduct. Bullying, hate speech, sharing answers to current examinations, spam, or commercial promotion are prohibited and may lead to removal from the community.
9. Analytics and Data Collection
We collect aggregated analytics to improve the Service (e.g., feature adoption, crash diagnostics) as outlined in our Privacy Policy. Personal performance data remains on your device unless future features require otherwise, in which case consent will be requested.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the Service will be accurate or reliable.
11. Limitation of Liability
NavyBlue is not liable for any indirect, incidental, special, or consequential damages arising from the use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using it.
You agree to indemnify and hold harmless the company, its directors, employees, and partners against claims arising from your misuse of the Service.
12. Third-Party Services
The Service may link to third-party products such as Google Play. Those services are governed by their own terms and privacy policies, which you should review.
13. Termination
We may suspend or terminate access to the Service at any time for conduct that violates these Terms or harms other users. You may stop using the Service at any time.
14. POPIA and South African Law
We comply with the Protection of Personal Information Act (POPIA) and other applicable South African legislation. Any cross-border data transfers (for analytics or hosting) are handled in accordance with POPIA requirements.
15. Consumer Protection Act
We strive to ensure the Service aligns with the South African Consumer Protection Act. You may lodge complaints with the National Consumer Commission if you believe your consumer rights have been violated.
16. Changes to These Terms
We may update these Terms to reflect changes in the Service or legal requirements. Material changes will be communicated via the website or App. Continued use of the Service after updates constitutes acceptance of the revised Terms.
